Terms of Service

These Terms of Service ("Terms") govern your access to and use of the 0X9 website at 0x9.fun and the services connected to it (the "Service"), operated by 0X9 ("0X9", "we", "us"). By creating an account, running a campaign, joining as a creator, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you confirm you are authorized to bind that company to these Terms, and "you" refers to that company.
2. Accounts
You are responsible for the information you provide and for keeping your account secure. You may sign in with email or with a supported provider such as Google. You are responsible for all activity under your account. Tell us promptly at roan@0x9.fun if you suspect unauthorized use.
3. Campaigns and creator posts
- Companies choose a campaign budget and submit a product. Estimated organic views and creator counts shown on the site are good-faith projections, not guarantees of results. Actual performance depends on the product, the market, and audience response.
- Creators agree to post truthfully about products they are assigned, to comply with X's rules and applicable advertising-disclosure laws (including clearly disclosing paid or sponsored posts where required), and to provide accurate links to their posts.
- Posts are published on creators' own X accounts and are organic. We do not buy views, bots, or fake engagement, and we do not permit it.
4. Payments and fees
Campaign payments are processed through our payment provider, Whop. By checking out you authorize the applicable charge, including any disclosed platform processing fee shown at checkout. Prices are stated in US dollars unless noted. Except where required by law or expressly agreed in writing, payments are non-refundable once a campaign has begun. Creator payouts are governed by the separate arrangement provided to creators.
5. The AI assistant
Parts of the Service use an AI assistant to help our administrators draft and manage campaign actions. Any action proposed by the AI is reviewed and approved by a human before it takes effect. AI output may contain errors and is not professional advice.
6. Acceptable use
You agree not to:
- Use the Service for anything unlawful, deceptive, or infringing.
- Promote products that are fraudulent, illegal, or that you are not authorized to promote.
- Attempt to generate fake engagement, manipulate metrics, or circumvent payment.
- Access the Service by automated means without permission, or probe, scrape, or disrupt it.
- Upload content that is defamatory, hateful, or that violates another person's rights.
We may suspend or terminate accounts that violate these Terms.
7. Intellectual property
The Service, including its software, design, and content, belongs to 0X9 and its licensors. You keep ownership of the content you submit, and you grant us a non-exclusive license to use it as needed to operate the Service and run your campaign (for example, displaying post links and performance in dashboards and case studies, where you have agreed).
8. Third-party services
The Service relies on third parties such as Google, Whop, Resend, Talivia, OpenAI, and X. Your use of those services is also subject to their terms. We are not responsible for third-party services we do not control.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular campaign result will be achieved.
10. Limitation of liability
To the maximum extent permitted by law, 0X9 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the campaign giving rise to the claim in the 12 months before the claim.
11. Indemnification
You agree to indemnify and hold 0X9 harmless from claims arising out of your use of the Service, your content, or your violation of these Terms or of any law or third-party right.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. Sections that by their nature should survive termination (including payment, disclaimers, liability, and indemnity) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice. Continued use of the Service after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by applicable law, without regard to conflict-of-laws rules. Disputes will be resolved in the courts with jurisdiction over 0X9, except where applicable law gives you the right to bring a claim elsewhere.
